1. This appeal is directed against the judgment dated

29.04.2023 passed by Special Judge, SC & ST (Prevention of

Atrocities) Cases, Jalore in Sessions Case No.120/2021, whereby

the petitioner has been convicted and sentenced.

2. Office has reported that another appeal being D.B. Criminal

Appeal No.94/2023 against the same judgment by the same

appellant is already pending consideration before this Court.

3. Learned counsel for the appellant in D.B. Criminal Appeal

No.141/2023 indicated that the said appeal has been filed through

legal aid, it appears that the legal aid was sought by the appellant

and also made arrangements to question the validity of judgment

on his own, based on which, already an appeal being D.B. Criminal

Appeal No.94/2023 has been filed.

4. In that view of the matter, D.B. Criminal Appeal No.141/2023

is dismissed as withdrawn with liberty to pursue D.B. Criminal

Appeal No.94/2023.

5. The application seeking suspension of sentence i.e. D.B.

Criminal Misc. Suspension of Sentence Application No.930/2023

also stands dismissed.
