1. Learned counsel for the appellants has submitted that since

the proceedings under Section 23 of the Rajasthan Public Trust

Act, 1959 have already been concluded before the Assistant

Commissioner (First), Jaipur and the appellants have already

preferred appeal before the Assistant Commissioner, which is

pending consideration, this special appeal has rendered

infructuous.

2. In view of the above, this special appeal is dismissed as

having become infructuous.

3. Needless to say that the Commissioner shall not be

influenced by any of the observations made by the learned Single

Judge in the impugned order and shall consider and decide the

appeal filed on behalf of the appellants on merits strictly in

accordance with law.
