Learned counsel for the petitioner submits that the issue
raised in the present writ petition is squarely covered by judgment
in Namonarayan Sharma v. The State of Rajasthan & Ors. : D.B.
Special Appeal Writ No.908/2017, decided on 08.01.2020 at Jaipur
Bench, which judgment has been followed in Mithlesh Rajput v.
State of Rajasthan & Ors. : S.B.Civil Writ Petition No.12992/2020,
wherein it has been directed as under:-
"Without pronouncing upon petitioner's right, the present writ petition is disposed of with the direction to the petitioner to file a representation before the competent authority within a period of 15 days, alongwith the copy of the order instant and a photocopy/ web copy of the Division Bench judgment passed in Namonarayan Sharma's case (supra).
In case such representation is filed within a period of two weeks from today, the respondent shall consider petitioner's case also, in accordance with
[2023/RJJD/013697] (2 of 2) [CW-16425/2022]
enunciation made in Namonarayan Sharma's case (supra).
The stay application also stands disposed of."
In view of the submissions made, the present writ is also
disposed of with similar directions as given in the case of
Namonarayan Sharma (supra).
The order has been passed based on the submissions made
in the petition, the respondents would be free to examine the
veracity of the submissions made in the petition and only in case,
the averments made therein are found to be correct, the petitioner
would be entitled to the relief.
