In this bunch of writ petitions, the petitioners have assailed

the orders of Maintenance Tribunal constituted under Maintenance

(10 of 11) [CW-11941/2021]

and Welfare of Parents and Senior Citizens Act, 2007 (for short

'the Act of 2007').

All the writ petitions have been filed by the children or

relatives. On 10.03.2020 an issue was raised from the

respondents side that the writ petition against the order of

Maintenance Tribunal under the Provision, of the Act of 2007 is not

maintainable for the reasons that a statutory remedy of appeal

under Section 16 of the Act of 2007 is available to the aggrieved

person/s, including the children and relatives. On 14.02.2023, the

arguments in regard to the issue of maintainability of the writ

petitions were heard from both the sides and the order was

reserved.

While drafting the judgment on the basis of the arguments

made by the parties in regard to the interpretation of provisions,

of the Act of 2007 related to the remedy of appeal to the children

and relatives against order of Tribunal, this Court felt that before

giving any interpretation to the provisions in regard to the remedy

of appeal and maintainability of these writ petitions, the Union of

India may also be heard, because the Act of 2007 is a Central

Legislation.

In view of the above, Registrar (Judicial), Rajasthan High

Court, Jaipur Bench, Jaipur is directed to serve a copy of this order

and copy of S.B. Civil Writ Petition No. 11941/2021 Maya Devi vs.

Vishweshwar Dayal & Anr. in the Office of Mr. R.D. Rastogi,

Additional Solicitor General. Mr. R.D. Rastogi, Additional Solicitor

General may appear before the Court and may make submissions

in regard to the availability of remedy of appeal to the children

and the relatives under Section 16 of the Act of 2007 against the

order of Maintenance Tribunal.

Name of Mr. Aashish Kumar, Adv. be shown in the cause-list.

Mr. R.D. Rastogi, Additional Solicitor General is also directed

to submit on record the copy of Original Gazette Notification in

connection with the Act of 2007 and subsequent amendments.
