Counsel for the petitioner has filed this review petition along

with the application under Section 5 of the Limitation Act for

condonation of delay in filing the review petition against the order

dated 19.07.2017, passed by the Court in S.B. Civil Writ Petition

No.4792/2017, stating therein that earlier against the order dated

19.07.2017, passed by this Court, D.B. Special Appeal (Writ)

No.1168/2017 was filed and the aforesaid special appeal was

disposed of vide order dated 02.11.2018, with liberty to the

petitioner to move the proper application before the learned Single

Judge pointing out that the arguments raised therein were

advanced but were not dealt with by the learned Single Judge.

I have considered the contentions.

The reasons stated in the application are that delay has

occurred in filing the review petition because of pendency of the

appeal before the Division Bench against the same order. Thus the

delay occurred in filing the review petition deserves to be

condoned.

Accordingly, application filed under Section 5 of the

Limitation Act for condonation of delay is allowed.

Review petition may be listed for admission.
