Shri Anil Bishnoi, learned counsel representing the appellant

frankly concedes that the controversy does not survive in view of

the fact that identical writ petition being D.B. Special Appeal (Writ)

No.1066/2022 (Prakash Chandra Vs. State of Rajasthan & Ors.)

has been dismissed by Division Bench of this Court vide judgment

dated 19.01.2023. Hence, the instant intra court appeal is also

rejected in light of the order referred to supra.
