These applications for anticipatory bail have been filed by the

petitioners apprehending their arrest in connection with FIR

No.230/2021 registered at Police Station Mehandipur Balaji,

District Dausa for the offence(s) under Section(s) 420, 467, 468

& 120-B IPC and later on for the offences under Sections 420,

467, 468, 471, 474 & 120-B IPC

Learned counsels for the petitioners submit that they have

falsely been implicated in these cases. Referring to the order

dated 30.07.2022 passed by the learned Senior Civil Judge,

Mahuwa, District Dausa in Civil Case No.7/2022: Hansraj Meena

[2023:RJ-JP:40845] (2 of 2) [CRLMB-1525/2023]

versus Kishan Meena & Ors., they would submit that on their

admission/confession, the subject Patta has been cancelled. They

submit that in pursuance of direction of this Court, they have

already joined the investigation. They, therefore, pray that the

petitioners may be extended benefit of pre-arrest bail.

Per contra, learned Government Advocate cum Additional

Advocate General submits that there are grave allegation against

the petitioners of forging a Patta allegedly issued by the Gram

Panchayat which has been found to be substantiated during the

course of investigation. He submits that during the course of their

interrogation, the petitioners have admitted that they have forged

the Patta. He, therefore, prays for dismissal of the anticipatory

bail applications.

Heard. Considered.

From the material available on record, it is revealed that

there is grave allegation against the petitioners of forging a Patta

and the allegation has been found to be substantiated during the

course of investigation. Further, during the course of their

interrogation, even the petitioners have admitted that to obtain a

loan, they forged the Patta. The confession extended by the

petitioners in the Civil Suit No.7/2022 only fortifies the allegation

levelled against them.

In view of the nature and gravity of allegations against the

petitioners; but, without expressing any opinion on the merits of

the case, they do not deserve indulgence of pre-arrest bail.

Resultantly, these anticipatory bail applications are

dismissed.
