HON'BLE MR. JUSTICE FARJAND ALI Order 16/08/2023

1. An application has been filed on behalf of the applicant for

treating the instant leave to appeal as an appeal under Proviso of

Section 272 of Cr.P.C.

2. Since, an appellate right has been conferred upon the victim/

complainant of a case who move an appeal against the judgment

of acquittal, therefore, I deem it just proper to allow the

application.

3. Accordingly, the application is allowed.

4. The memo of leave to appeal be treated and registered as an

appeal.

5. The leave application is disposed of.
