1. This writ petition has been filed by the petitioners aggrieved

against the order dated 10.01.2017 (Annex.13) passed by the

respondents, whereby the representation made by the petitioners

pursuant to the order dated 11.11.2016 passed in S.B. Civil Writ

Petition No. 8318/2016 has been rejected.

2. It is inter alia submitted by learned counsel for the

petitioners that the Division Bench judgment of this Court in State

of Rajasthan V. Banne Khan : S.A.W. No. 763/2011 decided on

02.08.2011 could not be brought to the notice of the respondents

while deciding the representation dated 10.01.2017 (Annex.13)

and once the said judgment was brought to the notice of the

respondents, persons similarly situated to the petitioners have

been granted the relief as sought in the present writ petition by

order dated 01.08.2016 (Annex.15) and therefore, a prayer has

been made that the respondents may be directed to reconsider

the case of the petitioners in light of the judgment in the case of

Banne Khan (supra).

3. In view of the above submissions made by the learned

counsel for the respondents, the writ petition filed by the

petitioners is disposed of requiring the petitioners to submit a

copy of the present writ petition alongwith a copy of this order to

the appropriate authority. The appropriate authority is directed to

consider and deal with the petitioners' grievances by reasoned

speaking order within a period of eight weeks from the date of

submission of this order. It is made clear that even thereafter

petitioners' grievance survives, they will be at liberty to take

recourse to appropriate proceedings.

4. All the interlocutory application(s) including the stay

application stand disposed of.
