Learned counsel for appellant fairly admits that client has

taken back the file from him and he pleads no instructions.

Appellant-plaintiff has filed this first appeal challenging the

judgment and decree dated 08.07.1999, whereby and whereunder

his civil suit No.70/1995 for claiming damages for mental agony

was dismissed on merits.

Appellant has moved application No.1/2000, seeking

exemption of court fees, alleging himself to be indigent person

under Order 44 Rule 1 CPC, on which this Court called for the

inquiry report from the concerned Collector. In pursuance thereof,

Collector has submitted the report which does not favour the

appellant to show his status as indigent person.

No other material was placed on record by the appellant-

plaintiff in support of his application, therefore, the application

No.1/2000 is dismissed.

Appellant-plaintiff is at liberty to pay the requisite court fees,

if he wants to pursue the instant first appeal on merits within a

period of four weeks, failing which, the C.F.A. No.3137/1999 shall

stand dismissed without further reference to this Court.
