Order

22/11/2022 Appellant-State has challenged the judgment and decree

dated 17.3.2020 passed by Additional District Judge No.6, Kota in

civil appeal No.29/2019 and the second appeal has been filed on

02.02.2021. During this period, because of Pandemic Covid-19,

the period of limitation was extended by the Hon'ble Supreme

Court Suo Motu in case of In Re: Cognizance for Extension of

Limitation [(2022) 3 SCC 117].

Notices were issued to respondent who has not appeared but

reply to the application has been sent by post.

For reasons discussed hereinabove, the delay in filing second

appeal is condoned and same is treated within limitation.

The application under Section 5 of the Limitation Act stands

disposed of.

List for admission on 07.12.2022.
