For Petitioner(s) : Mr. Tanveer Ahamad
HON'BLE MR. JUSTICE VIJAY BISHNOI
Judgment / Order
18/11/2022
This writ petition is filed by the petitioner being
aggrieved with the order dated 13.3.2020, whereby services
of the petitioner have been discontinued treating as if she is
resigned from the government service on 7.2.2012. Learned
counsel has submitted that the impugned order is passed in
violation of the provisions of Rule 86 of the Rajasthan Service
Rules, 1951 as also without providing any opportunity of
hearing to the petitioner.
Issue notice of the writ petition, returnable within six
weeks.
Learned counsel for the petitioner is free to serve copy
of the writ petition upon learned counsel, who usually appear
for the respondents.
(2 of 2) [CW-17019/2022]
Taking into consideration the fact that the impugned
order is passed around 2½ years, I am not inclined to pass
any interim order at this stage.
Hence, the stay petition is dismissed.
