Heard learned counsel for the petitioner and learned Public
Prosecutor as well as learned counsel for the respondent No.2.
Perused the judgment impugned available on record.
This Court is of the opinion that there are valid and
substantial grounds for grant of leave to the appellant applicant
Nathuram for filing an appeal against the acquittal of the
respondent No.2 vide impugned judgment.
Accordingly, the application for grant of leave to appeal is
allowed. The memo of leave to appeal be treated as an appeal and
it be registered as such. The accused-respondent is represented
by his counsel, thus, notice need not be issued to him. He is
directed to appear on or before 04.01.2023 to mark his presence
before the Registrar (Judicial), Rajathan High Court, Jodhpur.
Record has been received.
