Learned counsel for the parties are in agreement that the

controversy involved in the instant writ petition is squarely

covered by a decision of this court at Jaipur Bench in S.B.Civil

Writ Petition No.9408/2012 Mahesh Kumar Sharma & Ors.

Vs State of Rajasthan & Anr.) decided on 28.02.2013.

In view of statement made before this court, it is directed

that the petitioner shall file a detailed representation before the

respondents No.1 & 2 within a period of one week from today and

(2 of 2) [CW-10808/2022]

the same shall be decided within a period of two weeks thereafter.

While deciding the representation of the petitioner, the

respondents shall take into account the judgment of this court

rendered in the case of Mahesh Kumar Sharma (Supra).

Till the representation filed by the petitioner is decided by

the respondents No.1 & 2, they shall not allot the shops in

question.

The present writ petition is disposed of in the above terms.
