This writ petition has been filed by the petitioner seeking a

direction to the respondents to accord appointment to the

petitioner as per order dated 07.05.2018 (Annex.-3).

The petitioner had approached this Court by filing SBCW No.

6166/2018 pertaining to LDC Recruitment-2013, which petition

came to be decided by order dated 07.05.2018 by holding that the

issue was covered by judgment in Bada Bariya v. State of Raj. &

Anr.: SBCW No. 12677/2017, decided on 11.10.2017 and the

respondents were directed to consider the case of the petitioner

for grant of appointment to the post of LDC while taking into

consideration his qualification/Diploma in Computer Application

(2 of 2) [CW-15190/2022]

dated 05.09.2012 as a Post-Graduation issued by Dr. C.V. Raman

University, Bilaspur.

Now, the respondents have issued circular dated 07.09.2022

for filling-up 4000 vacant posts of LDC pursuant to the

Recruitment-2013, however, none of the posts in petitioner's

category i.e. TSP-ST has been indicated by the respondents while

other posts have been indicated.

Learned counsel appearing for the State made submissions

that as the respondents had already accorded more appointments

in petitioner's category i.e. TSP-ST in the recruitment already

initiated in the year 2013, even though 4000 posts all over the

State are being filled-up, in petitioner's category, none of the

posts are to be filled up, which aspect is evident from the list of

posts produced by the petitioner dated 16.09.2022 of the

candidates, who have been called for document verification.

In view of the above fact situation, where none of the post in

petitioner's category is vacant, even at the time when the order

dated 07.05.2018 (Annex.-3) was passed by this Court, no case

for grant of any direction is made out in the present writ petition,

the same is, therefore, dismissed.
