Due to paucity of time, the matter could not be taken up for

hearing.

On 27.07.2022, learned counsel for the respondents had

given an undertaking that he would inform the counsel appearing

before the trial court to take a date with a prayer before the trial

court not to dispose of the pending case. However, after

27.07.2022, the matter could not reach on regular board.

Learned counsel for the respondents submits that during the

intervening period, the learned trial Court heard the arguments

and fixed the matter for pronouncement on 09.11.2022.

Considering the submissions made and taking into account

the undertaking given by the learned counsel for the respondents

on 27.07.2022, in the interest of justice, it is expedient that the

learned trial Court shall not pronounce the judgment on

09.11.2022 till the next date of hearing before this Court.

List the matter on 23.11.2022.
