Learned counsel for the petitioners made submissions that
the petitioners are entitled to seek relief as granted in the case of
Indu Patel v. Rajasthan Board of Secondary Education Ajmer &
Anr.: S.B. Civil Writ Petition No.16767/2021, decided on 2.3.2022
and that the petitioners have questioned the validity of more
questions in the examination besides what has been decided by
the Court in the case of Indu Patel (supra).
Learned counsel appearing for the Board made submissions
that against the judgment in the case of Indu Patel (supra), in
(2 of 2) [CW-1382/2022]
D.B. Special Appeal Writ No.160/2022, impugned judgment has
been stayed.
Further submissions have been made that the petitions filed
are highly belated, inasmuch as, the final answer key was
published on 2.11.2021 and the petitions have been filed as late
as 20.1.2022 onwards and the last such petition has been filed on
19.2.2022.
In view of the fact that the respondents in appeal have
questioned the jurisdiction of the Court to pass the order in similar
nature matter and apparently, the petitions are belated, list these
petitions are six weeks, awaiting the result in the appeal/s filed by
the Respondent - State.
In case the appeal/s is/are decided earlier, the parties would
be free to file application in this regard.
