After hearing learned counsel for the parties, particularly

taking into consideration that the order passed by the learned

Single Judge is based on the judgment of the Division Bench of

this Court in the case of State of Rajasthan & Ors. Versus Ms.

Jamna Rajpurohit (D.B. Civil Special Appeal No.82/2013),

decided on 30.08.2013, which has been held per incuriam vide

order dated 09.09.2016 passed in State of Rajasthan &

Another Versus Jagdish Prasad and Another (D.B. Civil

Special (Writ) No.611/2016), we are inclined to direct that the

effect and operation of the impugned order shall remain stayed.

Matter be listed for final hearing.
