1. Petitioner has filed this third bail application under Section

439 Cr.P.C.

2. F.I.R. No.37/2020 was registered at Police Station Aklera

(Jhalawar) for offence under Sections 8/15 and 29 of the NDPS

Act.

3. It is contended by counsel for the petitioner that the

contraband was not recovered from the petitioner. It is only basis

of confessional statement that he has been made an accused.

4. Learned Public Prosecutor has opposed the third bail

application. It is contended that petitioner has criminal

antecedents of like nature.

5. I have considered the contentions.

6. From the statement of PW-2, it is evident that at the time

(2 of 2) [CRLMB-6285/2022]

when the material was recovered the accused apprehended, has

specifically stated that the articles belong to the petitioner and

one Dharamraj. They were only asked to take the material across

the toll naka. Taking note of the fact that petitioner has criminal

antecedents of like nature, hence, I am not inclined to entertain

the third bail application.

7. This third bail application is, accordingly, dismissed.
