14/01/2022

1. By way of present writ petition, the petitioner has challenged

the notice dated 21.12.2021 issued by the Patwari asking them to

remove their purported encroachment within three days.

2. The petitioner has approached this Court with a case that the

land in question, has been sold to the petitioner under provisions

of Panchayati Raj Act and Rules framed thereunder and therefore,

there is no encroachment.

3. In the opinion of this court, petitioner's writ petition is pre-

mature, inasmuchas even without filing reply, the petitioner has

rushed to this Court.

4. The petitioner seeks liberty to withdraw the present writ

petition with liberty to file their reply to the notice dated

21.12.2021 issued by the Patwari.

5. Hence, this writ petition is dismissed as withdrawn with the

liberty to the petitioner to file reply and seek appropriate remedies

under the law.

6. Stay petition also stands disposed of accordingly.
