1. Petitioner has filed this bail application under Section

439 of Cr.P.C.

2. F.I.R. No. 212/2019 registered at Police Station Dadabadi,

Kota (Raj.) for offence under Sections 376 of I.P.C. and Sections

3/4 of POCSO Act.

3. It is contended by counsel for the petitioner that petitioner

has remained in custody for a period of two years and six months.

Out of 21 witnesses, Only 15 witnesses have been examined.

Conclusion of trial will take time.

4. Learned Public Prosecutor has opposed the bail application. It

is contended that the Criminal Appeal No. 772/2020 was

dismissed after considering the statement of the child witness who

happens to be aged 13 years. It is also contended that there is no

change in circumstance so as to entertain the bail application.

5. I have considered the contentions.

6. Court has rejected the Criminal Appeal No. 772/2020 on

26.11.2020 after considering the statement of the child witness.

7. No ground is made out for entertaining the bail application,

merely, on the ground that the petitioner has remained in custody

for a period two years and six months. This Court is not inclined to

entertain the bail application.

8. This Criminal Misc. Bail Application is accordingly, dismissed.

9. However, trial Court is directed to expedite the disposal of

the case.
