It is submitted by learned counsel for the petitioner that in

petitions raising similar issue, the Co-ordinate Bench of this Court

has issued notices and has granted interim order.

In view of the submissions made, issue notice. Issue notice

of stay application also.

A copy of the writ petition be served on Mr. K.S. Rajpurohit,

AAG, who may complete his instructions in the matter.

List on 10.02.2022 after reflecting the name of Mr. K.S.

Rajpurohit, AAG, as counsel appearing for the respondents, in the

cause list.

In the meanwhile, the petitioner's candidature shall not be

rejected on the ground that the respondent department has

mentioned him as Lab Assistant whereas earlier he

has been given certificate of being working as a Lab Assistant. The

consideration being made by the respondent shall include the

petitioner provisionally for appointment on the post of Lab

(2 of 2) [CW-1698/2022]

Assistant as per his seniority list. The exclusion shall not take

place on the ground of petitioner being mentioned as Lab

Assistant at a belated stage.

The appointment of the petitioner in case given shall be

provisional and subject to the final outcome of this writ petition.
