1. Mr. Bijarnia, learned counsel for the petitioner, submits that

petitioner has been allotted land in the year 1989 and in light of

judgment dated 27.05.1993, rendered by Coordinate Bench of this

Court in the case of Teeja Devi Vs. State & Ors. (SBCWP

No.921/1993), which has been affirmed up to the Supreme Court,

a conscious decision has been taken by the State Government that

the said judgment will be applicable to all the allottees, the

petitioner cannot be dispossessed by the Forest Department.

2. Learned counsel submits that in identical matter being

SBCWP No.5449/2018, this Court has passed interim order while

issuing notices.

3. Hence, issue notice. Issue notice of stay application also,

returnable within eight weeks.

4. Meanwhile, the petitioner shall not be dispossessed from the

land allotted to him.
