This Special Appeal has been preferred by the appellant -

State with a delay of 181 days. The application under Section 5 of

the Limitation Act has been filed.

The State has challenged the order dated 15.03.2018 passed

by the learned Single Judge in SB Civil Writ Petition

No.11730/2016 (Shree Sawai College of Nursing Vs. State of

Rajasthan & Ors.) whereby, the application preferred on behalf of

the State under Article 226(3) of the Constitution of India with a

(2 of 2) [SAW-1228/2019]

prayer for vacating the ex-parte interim order dated 07.10.2016 in

the above-referred writ petition has been dismissed.

Having heard learned counsel for the appellants on the

application under Section 5 of the Limitation Act so also the

Special Appeal on merits, we do not find any case for interference

in the Special Appeal and the same is dismissed as such.

The application under Section 5 of the Limitation Act is also

disposed of.
