S.B. Civil Misc. Stay Application No.1755/2021:-

In the meanwhile, execution of the impugned judgment

and decree dated 17.08.2021 passed by the Court of District

Judge, Dholpur (Raj.) shall remain stayed subject to the condition

that the appellants deposit the entire award amount with the

learned Court within a period of one month from today. If the

entire award amount is deposited with the concerned Court within

the specified period, the concerned Court is directed to disburse

50% of the deposited amount to the claimants on their furnishing

an undertaking before the concerned Court to the effect that if the

appellants ultimately succeeds in this appeal, the said amount

shall be refunded to the appellants with interest @ 6% per annum

from the date of withdrawal. The remaining 50% of deposited

amount be invested in FDR in any nationalized bank for a period of

one year, which shall be renewed from time to time.

The stay application stands disposed of.
