Learned counsel for the petitioner has submitted that the
controversy involved in this writ petition is squarely covered by
the judgment dated 13.01.2017 passed by a Coordinate Bench of
this Court in Sumer Singh Vs. State of Rajasthan & Ors. (SB
Civil Writ Petition No.7675/2014) and the same has been
affirmed by the Division Bench of this Court vide order dated
25.07.2017 passed in The State of Rajasthan & Ors. Vs.
Sumer Singh (D.B. Special Appeal Writ No.492/2017).
Mr. A.K. Gaur, learned AAG has opposed the prayer of the
petitioner, however, he is not in a position to dispute the above
fact that the controversy involved in this writ petition is squarely

covered by the decision rendered in Sumer Singh's case (supra)
and has been affirmed in The State of Rajasthan's case (supra).
In such circumstances, this writ petition is allowed. The
respondents are directed to reimburse all the expenditures
claimed by the petitioner vide Annexure-1 within a period of six
weeks from the date of production of certified copy of this order.
