Citation : 2021 Latest Caselaw 17583 Raj
Judgement Date : 24 November, 2021

Rajasthan High Court - Jodhpur
Kailash Rathore vs Rajasthan Public Service ... on 24 November, 2021
Bench: Vijay Bishnoi

HIGH COURT OF JUDICATURE FOR RAJASTHAN JODHPUR

S.B. Civil Writ Petition No. 16533/2018

Kailash Rathore

----Petitioner Versus

Rajasthan Public Service Commission & Ors.

----Respondents

For Petitioner(s) : Mr. Kuldeep Mathur, Mr. L.S. Udawat

For Respondent(s) : Mr. Mahesh Thanvi, Mr. Himanshu Shrimali, Mr. Mukesh Rajpurohit, Mr.Rohit Mutha

HON'BLE MR. JUSTICE VIJAY BISHNOI

Judgment / Order

24/11/2021

The matter comes up for consideration of application

(01/19) preferred on behalf of the respondent - RPSC

and application (01/21) preferred on behalf of petitioner

seeking early hearing of the case.

Since the application (02/19) preferred on behalf of

some of the applicants for impleading them as party

respondents in the writ petition has rendered infructuous

in view of the order passed by this Court on 17.7.2019,

the same is dismissed as such.

The issue involved in this writ petition is regarding

equivalence of degrees of M. Tech (Computer Science)

and M. Tech (Information Technology) for the purpose of

(2 of 2) [CW-16533/2018]

appointment on the post of lecturer (Computer Science).

The respondents - RPSC as well as the State have

placed on record a report of the Committee dated

23.1.2018 claiming that the said Committee has opined

that the degree of M. Tech (Information Technology) is

not equivalent to the degree of M. Tech (Computer

Science).

Having gone through the report of the Committee

(Annex.R3/1) along with reply of the State, I am of the

view that no clear finding has been recorded by the said

Committee in relation to equivalence of the aforesaid two

degrees.

In such circumstances, I deem it appropriate to

direct the respondent No.3 to constitute a Committee of

the Professors of a recognized university for the purpose

of giving its opinion on the question of equivalence of the

aforesaid two degrees.

The respondent No.3 shall submit report of the

Committee before this Court by the next date of hearing.

List on 11.1.2022.

The applications (01/19 & 01/21) are disposed of.
