the factual report submitted by the learned Public Prosecutor, he

does not want to press this petition at this stage, however, seeks

liberty to file appropriate proceedings before the trial court.

The factual report produced by learned Pubic Prosecutor is

taken on record.

Accordingly, the misc. petition is dismissed as not pressed

with liberty as aforesaid.
