Heard learned counsel for the appellants.

This appeal has been preferred by the appellants being

aggrieved with the order dated 30th of September, 2019 passed by

the learned Single Judge in S.B. Civil Writ Petition No.6870/2019.

The learned Single Judge has dismissed the writ petition filed on

behalf of the appellants while relying on a decision dated

17.7.2019 rendered in S.B. Civil Writ Petition No.6211/2018 (State

of Rajasthan & Ors. Vs. Jagdish Chandra).

The learned Single Judge, after taking into consideration the

earlier judgments passed by this Court in S.B. Civil Writ Petition

Nos.4508/2005 and 4509/2005 decided on 18.11.2013 has held

(2 of 2) [SAW-135/2020]

that the directions given by the learned Labour Court to grant

benefit of regular pay scale to the respondent cannot be faulted as

the challenge to the award of the Labour Court reinstating the

respondent has attained finality.

Having heard learned counsel for the appellants and having

gone through the judgment dated 30.9.2019 passed by the

learned Single Judge in S.B. Civil Writ Petition No.6211/2018

(State of Rajasthan Vs. Jagdish Chandra), we do not find any

merit in this appeal.

Therefore, this special appeal is dismissed. The application

under Section 5 of the Limitation Act as well as the stay

application are also dismissed.
