Learned counsel for the appellant submits that the present

appeal has been preferred against the order dated 18.02.2010

passed on an application preferred under Section 140 of MV Act.

(2 of 2) [CMA-3553/2011]

During the pendency of the present appeal, the claim

petition itself has been decided on 19.08.2013, therefore, nothing

survives in the present appeal.

Accordingly, the present appeal is dismissed as infructuous.
