The instant misc. petition has been filed by the petitioner

accused Chaina Ram for assailing the order dated 21.08.2020

passed by learned Additional Sessions Judge, Banswara in

Criminal Revision No.08/2018 whereby, the order dated

09.01.2018 passed by learned Additional Chief Judicial Magistrate,

Kushalgarh in Criminal Case No.03/2014 directed framing of

charges against the petitioner for the offences under Section 409,

379, 167 and 221 IPC was affirmed.

Shri Ranjeet Joshi, learned counsel representing the

petitioner frankly concedes that in the intervening period, almost

all of the prosecution witnesses have been examined and the

statement of only one witness i.e,. Dy. Superintendent of Police

(2 of 2) [CRLMP-3586/2020]

Jagdish Narayan remains to be recorded in the trial. He urges that

the case is pending for recording of this last witness for the last

almost one and a half year and therefore, suitable direction may

be given to the trial court to conclude the trial expeditiously.

The prayer, so made is justified.

Thus, the trial court is requested to conclude trial as

expeditiously as possible. Needless to say that the petitioner shall

be at liberty to raise all his objections before the trial court at an

appropriate stage.

With the above observations, the instant misc. petition is

dismissed as infructuous.
