Heard learned counsel for the petitioner, learned Public

Prosecutor and perused the material available on record.

The instant misc petition has been filed by the petitioner

Akhlaq Ahmed for quashing of the order dated 22.04.2019 passed

by learned Addl. Sessions Judge No.4, Bikaner in revision

(No.44/2019) whereby the order dated 02.02.2019 passed by

Chief Judicial Magistrate, Bikaner in Criminal Case No. 820/2018

framing charges against the petitioner for the offences under

Sections 456 & 427 IPC was affirmed.

After having heard and considered the submissions advanced

by counsel for the petitioner and learned Public Prosecutor and

after going through the impugned order, I am of the opinion that

the trial court has duly applied its mind to the facts of the case

(2 of 2) [CRLMP-6953/2019]

and has passed a detailed order in accordance with Section 240

Cr.P.C. while directing framing of charges against the petitioner.

The order passed by the trial court has also been affirmed by the

revisional court. Two courts of competent jurisdiction have

recorded concurrent findings of facts against the petitioner.

In this view of the matter, this Court would be loathe to

interfere in this matter while exercising its revisional jurisdiction,

which is a second revision in the garb of misc. petition under

Section 482 Cr.P.C. Thus, I find no merit in this misc. petition

which is dismissed as being devoid of merit.
