Judgment

07/06/2021

Heard learned counsel for the parties. Perused the material

available on record.

The petitioner has approached this Court through this writ

petition under Article 226 of the Constitution of India seeking to

assail the adverse recommendations dated 12.05.2021 whereby,

the application for emergent parole filed on behalf of her husband

Narendra S/o Shri Sitaram Jat has been dismissed by

Superintendent, Central Jail, Bikaner.

We have heard and considered the submissions advanced at

bar and have gone through the impugned order.

(2 of 2) [CRLW-272/2021]

The convict Narendra is a hardened criminal and as many as

35 cases have been registered against him from the years 1995

onwards. He is presently undergoing life imprisonment at Central

Jail, Bikaner. The petitioner absconded twice while availing parole

facilities. Not only this, during period of his incarceration and while

suffering life imprisonment, the petitioner absconded from the

Open Air Camp and during the period of his abscondance, he was

found involved in a case under the NDPS Act. Numerous

convictions are recorded against the convict Narendra Kumar. In

this background, the possibility of the convict against absconding,

if released on emergent parole is imminent. Thus, we are of view

that the convict-prisoner Narendra S/o Shri Sitaram does not

deserves indulgence of emergent parole. Accordingly, the instant

parole writ petition is dismissed as being devoid of merit.
