This matter has come up on an application (IA No.1/2020)

for treating this Criminal Leave to Appeal as Criminal Appeal.

It has been submitted that the petitioner has filed this

criminal leave to appeal against the judgment dated 22.01.2020

passed by learned Sessions Judge, Sawai Madhopur, whereby, the

accused-respondent had been acquitted from the charges under

Sections 366 and 376 IPC.

Office of this Court has pointed out a defect that the appeal

against acquittal lies.

Therefore, this application is to treat this Criminal Leave to

Appeal as Criminal Appeal and amended cause titled is annexed

with the application.

In view of the submissions, application is allowed.

Office is directed to treat this Criminal Leave to Appeal as

Criminal Appeal. Amended cause titled be taken on record.

Office to proceed accordingly.
