By way of this writ petition, the petitioner has challenged the

order dated 05.03.2021 passed by the Adjudicating Authority

(ADM, Jaipur South Jaipur).

Learned Senior counsel submitted that against the order

passed by the Adjudicating Authority, the petitioner has filed an

appeal before the Food Safety Appellate Tribunal, Jaipur, however,

the Tribunal is not functioning due to non-appointment of

Presiding Officer there, as such, the petitioner has no remedy

except to file the present writ petition.

So far as the merits of the case is concerned, learned senior

counsel relied upon the judgment passed by the Hon'ble High

Court of Madhya Pradesh in the matter of I.T.C. Vs. State of M.P.

and Ors. [W.P. No.5427/2016] decided on 17.04.2017.

Heard counsel for the petitioner and perused the record.

Issue notice to the respondents, returnable on 23.08.2021.

Meanwhile, no coercive action shall be taken against the

petitioner.
