The matter comes up on an application filed by the

respondents seeking vacation of the interim order dated

17.01.2018.

By order dated 17.01.2018, the Court directed that the

recovery of the amount pursuant to the judgment & award dated

20.11.2017 shall remain stayed. Further, the Commissioner,

Workmen Compensation was directed to get an FDR prepared

pursuant to the amount deposited by the appellant in some

Nationalized Bank in its name and the FDR was directed to be kept

in safe custody.

After hearing counsel for the parties for some time, it is

deemed appropriate and, therefore, ordered that the

Commissioner, Workmen Compensation, who has placed the

amount deposited by the appellant in fixed deposit, shall liquidate

the fixed deposit and make payment of 50% of the maturity

amount of the fixed deposit to the respondent-workman and rest

of the amount shall be again placed in fixed deposit.

The payment of amount shall remain subject to the final

outcome of the present appeal and the rest of the interim order

shall continue.

The application stands disposed of.

The record be sent back to the Commissioner, with the

direction to send the same back once the amount is disbursed.

List the appeal for hearing in the month of November, 2021.
