This bail application has been filed under Section 439 Cr.P.C.

in connection with FIR No.239/2019 registered at Rajeev Gandhi

Nagar Police Station, Distt. Jodhpur, for offence under Section(s)

147, 148, 149, 323, 307, 427 of IPC.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the entire material available on

record.

Learned counsel for the petitioner submits that all the other

co-accused who were named in the FIR have already been granted

bail by the co-ordinate Bench of this Court while the petitioner

who has not been named in the FIR was denied bail by the trial

court solely on the ground of pending cases.

Learned Public Prosecutor has opposed the bail application.

                                        I    have    considered       the     submissions            and   taking   into

consideration that the main accused have been granted bail but

without commenting further on merits of the case, I am inclined to

grant bail to the petitioner.

Therefore, this bail application is allowed and it is ordered

that the accused petitioner Shyam Lal S/o Sh. Harchand Ram, be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR provided the petitioner furnishes a personal bond of

Rs.50,000/- with one surety in the like amount to the satisfaction

of the concerned Magistrate with the stipulation that he shall

comply with all the conditions laid down under Section 437(3)

Cr.P.C.
