This bail application has been filed by the petitioner under

Section 439 Cr.P.C. in connection with FIR No.01/2017 registered

at Chittorgarh CBN Police Station, District Chittorgarh for offence

under Sections 8/29 of the NDPS Act.

Heard learned counsel for the petitioner as well as learned

Special Public Prosecutor and perused the entire material available

on record.

Looking that the allegation against the petitioner is only

relating to Section 29 of the Act,, who is Booking Clerk at the

Travel Agency while the contraband was recovered from Manphool,

who was Driver of the Bus and that charge sheet has already been

filed, taking into consideration the over all aspects but without

commenting on merits of the case, I am inclined to release the

petitioner on bail.

Accordingly, this bail application is allowed and it is ordered

that the accused petitioner - Dilip Soni s/o Nand Lal Soni be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR No.01/2017 registered at Chittorgarh CBN Police

Station, District Chittorgarh provided the petitioner furnishes a

personal bond of Rs.50,000/- with one surety in the like amount,

to the satisfaction of the concerned Magistrate with the stipulation

that he shall comply with all the conditions laid down under

Section 437 (3) CrPC.
