1. Petitioner has filed this second bail application under Section

439 Cr.P.C.

2. F.I.R. No.369/2020 was registered at Police Station Sikri

District Bharatpur for offence under Sections 3 & 25 of Arms Act.

3. It is contended by counsel for the petitioner that the offence

is triable by the Magistrate. First bail application was dismissed on

the basis that petitioner was absconding in another case.

4. Counsel for the petitioner has placed an order on record,

from which it is revealed that the petitioner is attending the other

criminal cases, which is pending against him.

5. Learned Public Prosecutor has opposed the second bail

application.

6. I have considered the contentions.

7. Taking note of the fact that charge-sheet has been filed and

petitioner has remained in custody for a period of more than four

months, I deem it proper to allow the second bail application.

8. This second bail application is, accordingly, allowed and it is

directed that accused-petitioner shall be released on bail provided

he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees

One Lac only) together with two sureties in the sum of

Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction

of the trial Court with the stipulation that he shall appear before

that Court and any Court to which the matter be transferred, on

all subsequent dates of hearing and as and when called upon to do

so.
