Learned counsel for the petitioners has relied on the

judgment of the Constitution Bench of the Supreme Court in

Chairman Railways Board & Ors. Vs. C.R. Rangadhamaiah &

Ors., 1997 (6) SCC 623, to argue that retrospective amendment

in the Rules cannot take away the accrued and vested right from

an earlier date.

Issue notice to the respondents. Rule is made returnable by

six weeks.

In the meanwhile, no recovery shall be made from the

petitioners pursuant Notification Dated 30.10.2017 (Annexure-4).
