Heard learned counsel for the parties.

Learned counsel for the petitioner has submitted that

the petitioner is facing trial since more than two years. It

is submitted that charges have been framed and

statements of some of the prosecution witnesses have

been recorded before the trial court, however, trial of the

case will take time, therefore, the petitioner may be

enlarged on bail.

Per contra, learned Public Prosecutor has opposed

the bail application and submitted that huge quantity of

tablets and syrups containing narcotic substances has

been recovered at the instance of the petitioner. It is also

submitted that from the statements of prosecution

witnesses recorded before the trial court, involvement of

the petitioner in commission of crime is established.

Having gone through the overall facts and

circumstances of the case, particularly keeping in view

the fact that huge quantity of tablets and capsules

containing narcotic substances has been recovered at the

instance of the petitioner, which is more than commercial

quantity, I am not inclined to grant bail to the petitioner.

Hence, this third bail application is dismissed.
