1. Learned counsel for the petitioner submits that the petitioner

who is going to be superannuated on 20.6.2022 has been

transferred from Government Senior Secondary School, Palasani

to Government Senior Secondary School, Devki vide order dated

4.1.2021.

2. Learned counsel submits that the impugned order is

contrary to the judgment of this Court rendered in the case of

Dr.Pushpa Mehta Vs. State of Rajasthan reported in RLW 2000 (1)

page no. 233.

3. The matter requires consideration.

4. Issue notice. Issue notice of the stay application also.

5. Mr. Hemant Choudhary, learned counsel accepts notice on

behalf of respondents no.1 and 2 and prays for and is granted four

weeks' time to file reply.

6. Let notices be issued to the respondent no.3.

7. Meanwhile, effect and operation of the transfer order dated

4.1.2021 (Annex.2) (qua the petitioner) and relieving order dated

6.1.2021 (Annex.5) shall remain stayed.
