1. Petitioner has filed this second bail application under Section

439 Cr.P.C.

2. F.I.R. No.48/2020 was registered at Police Station Ayana,

Kota Rural for offence under Sections 376 & 376-D I.P.C. and

Sections 5(G), 9g and 6 of POCSO Act.

3. It is contended by counsel for the petitioner that a false case

has been registered against the petitioner.

4. Learned Public Prosecutor has opposed the second bail

application. It is contended that prosecutrix is a child, aged

sixteen years. In the Court statement, she has levelled allegation

with regard to rape against the present petitioner and prosecutrix

received injuries on her private part also.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the second bail application.

7. This second bail application is, accordingly, dismissed.
