Heard learned counsel for the appellants-defendants.

Admit.

Issue notice to the respondents/plaintiffs.

Call for the record.

In S.B. Civil Misc. Application No.1232/2020-

The matter comes up for orders on an application

No.1232/2020 filed by the applicants under Section 5 of the

Limitation Act for condonation of delay in filing the present appeal.

For the reasons stated in the aforesaid application, the same

is allowed.

The delay in filing the application is condoned.

In S.B. Civil Misc. Stay Application No.2247/2020-

In the meantime, operation/execution of the impugned

judgment and award dated 30.11.2019 passed by the Court of

(2 of 2) [CFA-670/2020]

learned District and Sessions Judge, Laxmangarh District

Alwar(Raj.) shall remain stayed with the condition that the

appellants-defendants shall deposit the entire award amount

within a period of four weeks with the Court concerned. The

concerned Court is directed to disburse 50% of the award amount

to the claimants, subject to their furnishing an undertaking on

oath to the effect that if the appellants-defendants ultimately

succeeds in the appeal, the said amount shall be refunded with

interest from the date of disbursement till refunded. The

remaining 50% of the amount be invested in the FDR in a

nationalised bank with the direction for a period of one year which

shall be renewed from time to time.
