Counsel for the petitioners submit that initially FIR
No.192/98 in this matter was registered at Police Station Udyog
Nagar, District Bharatpur in which the negative final report was
submitted by the Investigating Agency in the year 1999 and the
same was also accepted by the concerned Magistrate. Counsel
further submits that again on 25.02.2000, a complaint was filed
by the complainant with regard to the same incident upon which
cognizance has been taken by the Magistrate. Counsel further
submits that two complaints/FIRs is not maintainable for the same
offences.
Counsel relied upon the judgment passed by the Hon'ble
Supreme Court in the matter of Krishna Lal Chawla & Ors. Vs.
State of Uttar Pradesh and another reported in
(2021) 5 SCC 435 decided on 08.03.2021.
In that view of the matter, issue notice to the respondents
returnable by six weeks.

List this petition for final disposal in the third week of
January, 2022.
Meanwhile, operation of the order dated 26.10.2017
(Annexure-3) shall remain stayed.
