Learned counsel representing the petitioner has placed

reliance on the case of Popcorn Entertainment & Anr. Vs. City

Industrial Development Corpn. & Anr. reported in (2007)9

SCC 593 and urges that the alternate remedy of appeal would not

hinder the right of the petitioner to prosecute this PIL more

particularly when the local body has granted permission for

commercial construction to the private respondents against the

building by laws & this Courts Judgment in the case of Gulab

Kothari.

Issue notice to the respondents. Rule is returnable on

21.01.2022. The construction, if any, being raised on the disputed

premises shall remain subject to outcome of this writ petition.
