Learned counsel for the petitioner has submitted that the

petitioner has been denied the retiral benefits as per the

provisions of the Rajasthan Civil Services (Pension) Rules, 1996

(for short 'the Rules of 1996') on the ground that a criminal case

punishable under sections 13(1)(d)(2) of the Prevention of

Corruption Act 1988 and Sections 420, 467, 468, 471 read with

Section 120-B IPC is pending against him. Learned counsel for the

petitioner has submitted that during pendency of the writ petition,

the petitioner has been discharged by the competent criminal

court from the charges for which criminal proceedings are initiated

against him.

Learned counsel for the petitioner has submitted that in view

of the subsequent developments, this writ petition may be

disposed of with liberty to the petitioner to move an appropriate

representation before the competent authority for granting him

benefits under the Rules of 1996.

In view of the limited prayer made by learned counsel for the

petitioner, this writ petition is disposed of with liberty to the

petitioner to move an appropriate representation before the

authority concerned indicating the subsequent developments

taken place and granting him benefits under the Rules of 1996

within period of four weeks from today.

If any representation is made by the petitioner, the

respondent authority shall consider and decide the same keeping

in view the subsequent developments taken place strictly in

accordance with law within a period of eight weeks thereafter.

Stay application as well as all other pending applications are

disposed of.
