Learned Public Prosecutor has submitted a factual
report dated 7.4.2021, as per which, notice of application
under Section 5 of the Limitation Act has been served
upon the respondent No.2, however, none is appeared on
his behalf.
The matter comes up for consideration of application
under Section 5 of the Limitation Act preferred on behalf
of appellant-Ramesh Kumar for condonation of delay of
366 days in filing the present criminal appeal.
Learned Public Prosecutor has not opposed the
application under Section 5 of the Limitation Act. Hence,
for the reasons mentioned in the application under
(2 of 2) [CRLAD-148/2020]
Section 5 of the Limitation Act, the same is allowed and
the delay of 366 days in filing the present criminal appeal
is condoned.
List alongwith DB Criminal Appeal No.301/2019.
