Heard learned counsel for the appellants.

The following substantial question of law arises for

consideration in the present appeal:-

(i) Whether the two courts below were justified in coming to the conclusion that the judgment (Ex.-P/3), could not be used to establish that the land in question was a public land and that the observations made by the court in Ex.- P/3, were obiter?

Admit. Issue notice.

In the meanwhile and till further orders, status quo, as it

exists today, qua the land in question, shall be maintained by the

parties.
