Judgment

05/04/2021 Heard learned counsel for the petitioners, learned Public Prosecutor and perused the case diary.

There is a distinct allegation that the petitioners were getting mining operations carried out in their khatedari lands without any lease/permission. The photographs taken by the Mining Engineer and the statements of the labour who were present at the spot doing work at the instance of the petitioner (recorded by the mining officials) are available on the case diary, which fortify this allegation. In this background, I am not inclined to extend indulgence of pre-arrest bail to the petitioners. Accordingly, the application for pre-arrest bail is rejected. In case, the petitioners surrender before the trial court within next fifteen days and apply for regular bail, such bail application shall be considered & decided as per law.
